
Seth has litigated a broad range of disputes, including cases involving professional liability, insurance defense, breaches of contract, class actions, both federal and state civil RICO/racketeering, antitrust, leases, defective design and construction claims, business valuations, business disputes, contested wills, and other business and commercial issues. Seth has represented his clients in both state and federal district courts and appellate courts as well as in arbitration. In addition to his litigation practice, Seth also has experience representing and counseling clients in transactional matters including asset sales and purchases, business mergers and acquisitions, business formation and reorganization, and general contract review. With a forward-thinking resolution focused approach, Seth strives to bring value to his clients and effectively solve their problems at every stage of the dispute resolution lifecycle, even in cases involving complex, multi-party litigation.
Experience:
- Defended Kenneth R. Feinberg in the multidistrict litigation arising out of the BP oil spill in the Gulf of Mexico and won dismissal of untimely and unmeritorious claims on Rule 12(b)(6) motions to dismiss. In Re Oil Spill by Oil Rig “Deepwater Horizon” in Gulf of Mexico, on 4/20/10, 2020 WL 3606261 (E.D. La. 7/2/20).
- Defended his client against federal racketeer influenced corrupt organizations act (“RICO”) claims and successfully had the claims dismissed on a Rule 12(b)(6) motion to dismiss. Lewis v. Louisiana State Univ., No. CV 21-198-SM-RLB, 2022 WL 2187098 (M.D. La. June 16, 2022). The dismissal was upheld on appeal by the U.S. Fifth Circuit Court of Appeals. Lewis v. Danos, 83 F.4th 948 (5th Cir. 2023).
- Defended his client against claims under the Louisiana Racketeering Act along with other state and federal claims and successfully had the claims dismissed on peremptory exceptions. Lewis v. Louisiana State University, et al, No. 708092, Section 22, 19th Judicial District Court, East Baton Rouge Parish, State of Louisiana.
